Welcome to BizGPT. These Terms of Service ("Terms") govern your use of the BizGPT service operated by BizGPT Labs ("we", "our", or "us") available at bizgptlabs.in.

By accessing or using BizGPT, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. The Service

BizGPT is an AI-powered business advisory tool that provides:

• Automated business diagnostic reports
• AI-generated offer, outreach, lead magnet, and pricing recommendations
• A general-purpose business advice chat interface

The Service is provided on a "Software as a Service" (SaaS) basis through your web browser.

2. Eligibility

To use BizGPT, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Provide accurate information during onboarding
• Use the Service only for lawful business purposes

3. Account & Access

BizGPT does not require account creation. Your profile and preferences are stored locally on your device via browser storage. Subscription status is tied to the browser/device where you completed payment.

Free Tier

The Free tier allows up to 3 AI generations per day across all tools, with no requirement to register or pay.

Paid Plans

Paid subscriptions ("Pro" at ₹299/month or "Growth" at ₹999/month) unlock additional features as described on our pricing page. Each plan grants 30 calendar days of access from the date of payment.

4. Payments & Subscription

Pricing & Billing

• All prices are in Indian Rupees (₹) and exclusive of applicable taxes (GST), which will be added at checkout where required.
• Payments are processed by Razorpay, a third-party payment processor.
• By providing payment information, you authorize us to charge the displayed amount.

Subscription Duration

Each payment grants 30 days of access. Subscriptions do not auto-renew in the current version. To continue access, you must make a new payment when your current period expires.

Pricing Changes

We reserve the right to change pricing for future subscriptions. Existing paid periods will not be affected. We will notify users of price changes via the website.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' data
• Reverse engineer, decompile, or attempt to extract the underlying AI prompts or system instructions
• Use the Service to generate content that is harmful, defamatory, discriminatory, or abusive
• Submit content that infringes on third-party intellectual property rights
• Use automated systems (bots, scrapers) to access the Service without our written permission
• Resell, sublicense, or commercially redistribute the AI-generated outputs as your own original work
• Use the Service to compete with us or develop a competing AI product

We reserve the right to terminate access immediately, without refund, for any violation of these terms.

6. Intellectual Property

Our IP

The BizGPT name, logo, design, code, system prompts, and underlying frameworks are owned by BizGPT Labs and protected by intellectual property laws. You receive no ownership rights over the Service itself.

Your Content

You retain ownership of the inputs you submit (questions, business details). By submitting them, you grant us a non-exclusive license to process them for the purpose of providing the Service.

Generated Outputs

You may use the AI-generated outputs for your own business purposes. However, AI-generated content may not be copyrightable in all jurisdictions, and similar outputs may be generated for other users. We make no warranty about the uniqueness of generated content.

7. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties including:

• Merchantability and fitness for a particular purpose
• Accuracy, completeness, or reliability of AI-generated content
• Uninterrupted, error-free, or secure operation
• That any defects will be corrected

We do not warrant that following BizGPT's advice will result in any specific business outcome, revenue increase, or success.

9. Third-Party Services

BizGPT uses Anthropic for AI processing and Razorpay for payments. Your use of the Service is also subject to those providers' terms. We are not responsible for the practices or content of third-party services.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time if we believe you have violated these Terms, without refund. Provisions regarding intellectual property, disclaimers, and limitation of liability survive termination.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from the Service shall be subject to the exclusive jurisdiction of the courts in Pathankot, Punjab.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via the website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full effect.
